(1) If any proposal is received in accordance with section 5, the relevant body will examine the preliminary environmental test or environmental impact assessment report attached to the proposal, if such proposal does not appear to have a significant adverse effect on the environment, the preliminary environmental test will be conducted. In the case of the proposal made, he will give his approval and send the proposal to the Ministry along with his opinion regarding the environmental impact assessment.
(2) Regardless of what is written in sub-section (1), if it appears that the environmental impact assessment of such a proposal should also be done while examining the preliminary environmental assessment report, the relevant body may order the environmental impact assessment of that proposal. In this way, if a proponent submits a proposal for approval after evaluating the environmental impact according to the order given by the relevant body, he/she shall send the proposal to the Ministry along with his/her opinion after conducting the necessary examination.
(3) If a report on environmental impact assessment is received with a proposal in accordance with sub-section (1) or (2), the ministry will arrange for the general public to download and carry the report themselves in order to suggest an opinion regarding the report.
(4) The Ministry may form a committee consisting of experts from related agencies to suggest opinions on the environmental impact assessment report received with the proposal in accordance with sub-section (1) or (2).
(5) If the general public has suggested any opinion in the environmental impact assessment report received in accordance with sub-section (1) or (2), and if a committee has been formed in accordance with sub-section (4), if such proposal does not appear to have a significant adverse effect on the environment based on the opinion and suggestion given by the committee. The Ministry will give approval to the proposer to implement such a proposal.
(6) Notwithstanding anything contained in sub-section (1) or (5), the preliminary environmental assessment or environmental impact assessment reportIf it is found that significant adverse effects on the environment can be reduced or controlled during the implementation of the proposal, the concerned agency or the ministry may approve the implementation of the proposal by specifying the necessary conditions.
(7) The initial environmental testing and environmental impact assessment of the proposal, the period to be approved for the implementation of the proposal and other provisions shall be as prescribed.
